Clare Butler Template Shop Terms & Licence

These Terms & Licence apply to website templates and associated digital products purchased from Clare Butler Co. By purchasing a template, you agree to these terms.
Please read them carefully before completing your purchase.
1. Template Licence
Your purchase gives you a limited, non-exclusive licence to use the template on one website only.
You may purchase and use a template:
for your own personal or business website; or
as a website designer, for one individual client website.
A separate template licence must be purchased for every additional website or client project.
If you are a designer purchasing a template for a client, the licence attaches to that particular client website and may pass to your client with ownership of the completed website.
You may customise the template, including its colours, fonts, imagery, copy and layouts, to suit your own business or your client's business.
2. What You May Not Do
You may not:
share, copy, distribute or provide the template to another person or designer;
use one template purchase to create multiple websites;
resell the template as a standalone product;
sublicense the template;
reproduce the template, in whole or in substantial part, to create your own template product for sale;
distribute or resell any guides, tutorials or other resources included with your purchase.
Website designers may charge their own clients for website design, customisation and implementation services carried out using a legitimately purchased template.
3. Attribution
You are not required to credit Clare Butler on a website created using one of my templates.
This applies whether you are using the template for your own website or are a website designer using it for a client project.
Designers are welcome to showcase their completed client websites within their own portfolios.
No attribution or Clare Butler credit is required in the website footer.
4. Template Delivery
Templates are supplied as new Squarespace websites.
Following your purchase, you will receive a Squarespace Contributor Invitation giving you access to your new template website. This will be sent to the email address provided with your order within 24 hours of purchase.
You must accept the Contributor Invitation to access the template through your Squarespace account.
You will also receive access to the Clare Butler Template Guide and any other resources specifically stated as being included with the template.
Please ensure that the email address provided when ordering is correct and check your spam or junk folder if you haven't received expected emails.
5. Existing Websites
My templates are currently supplied for new websites only.
At the present time, I do not offer template installation onto existing Squarespace websites.
If you already have a Squarespace website, your template will be provided as a separate new Squarespace website. You are responsible for transferring or recreating any content you wish to retain and connecting your existing domain to the new website when you are ready to launch.
Template customisation, content migration and website setup are not included with your template purchase unless expressly stated otherwise.
6. Squarespace Subscription
Your template purchase does not include a Squarespace website subscription unless this is specifically stated on the relevant product page.
You are responsible for purchasing and maintaining the Squarespace subscription required to publish and operate your website.
Squarespace is a third-party platform and may change its functionality, features, pricing, plans or software from time to time. Clare Butler Co is an independent Squarespace design business and does not control the Squarespace platform.
7. Complimentary Template Support
Your purchase includes 30 days of complimentary template support, beginning on the date your template is delivered.
Complimentary support covers reasonable questions relating to:
accessing your template;
following the instructions provided with it;
functionality included within the original template; and
identifying and resolving genuine faults or errors within the template as supplied
Complimentary support does not include:
general Squarespace training;
customising your website or template for you;
creating additional pages, sections or layouts;
custom coding;
adding functionality not included in the original template;
third-party applications or integrations;
SEO advice or strategy;
copywriting;
branding advice;
selecting fonts, colours, imagery or other creative elements;
uploading or formatting your website content; or
troubleshooting problems caused by alterations, custom code or changes made by you, another designer or another third party.
I aim to respond to support enquiries within 2–3 working days, Monday to Friday, excluding UK bank holidays and notified periods of annual leave.
Once the 30-day complimentary support period has ended, additional assistance may be available as a paid service at my current rates.
The expiry of complimentary support does not affect any statutory rights you may have in relation to faulty digital content.
8. Third-Party Fonts, Images and Resources
Demo websites may contain photography, fonts, graphics, plugins, integrations or other third-party resources used to demonstrate the design.
Unless the product description specifically states that a particular resource is included with your purchase, third-party assets are not included in your template licence.
Where third-party products or resources are required, you are responsible for obtaining any licences, subscriptions or permissions necessary for their use.
You are also responsible for ensuring that photographs, fonts, graphics, copy and other material you add to your website are properly licensed for your intended use.
9. Refunds and Cancellation
Templates are digital products.
If you are purchasing as a consumer, you will be asked at checkout to expressly request that the digital content is supplied before the end of the usual 14-day cancellation period and to acknowledge that your right to cancel will be lost once supply of the digital content begins.
Once digital content or access materials have been supplied following that consent, I do not provide refunds simply because you have:
changed your mind;
decided you no longer require the template;
purchased the wrong template;
decided Squarespace is not suitable for you; or
chosen not to use the template.
This does not affect your statutory rights.
If digital content supplied to you is faulty, not as described or does not otherwise meet your applicable statutory rights, please contact me at clare@clarebutler.co so that I can investigate and provide an appropriate remedy.
UK law gives consumers statutory protections for paid digital content and requires specific consent before digital content is supplied during the normal cancellation period.
10. Template Compatibility
Templates are designed for the version of Squarespace stated on the relevant product page and based on Squarespace functionality available at the time the template is sold.
Third-party platforms, browsers, applications and integrations may change over time.
I cannot guarantee that every design feature or third-party integration will remain unchanged or compatible indefinitely following future updates by Squarespace or another provider.
Where an issue is caused by a genuine fault in the template rather than a subsequent third-party change or customer modification, your statutory rights are unaffected.
11. Your Responsibility for Your Website
The template provides a design framework for your website.
You remain responsible for your finished website, including its:
copy and claims;
products and services;
images and other content;
privacy and cookie compliance;
accessibility;
legal notices and policies;
intellectual property permissions;
SEO;
integrations;
security and account access; and
ongoing maintenance.
Purchasing a template does not mean that Clare Butler Co has reviewed or approved the legal, regulatory or commercial compliance of your finished website.
12. Results and Guarantees
Purchasing or using a Clare Butler template does not guarantee any particular business, marketing, SEO or financial result.
Examples, testimonials, demonstrations, client results or case studies shown on my website illustrate possible outcomes but are not guarantees that you will achieve the same or similar results.
Website performance depends on many factors outside my control, including your content, offer, pricing, market, photography, marketing, SEO implementation, competition and ongoing management of your website.
I do not guarantee:
a particular Google or other search-engine ranking;
a particular level of website traffic;
enquiries or bookings;
sales;
conversion rates; or
any other commercial outcome.
13. Liability
I take reasonable care in creating, testing and supplying my templates.
However, I am not responsible for problems or losses caused by:
changes you or another person make to the template;
custom code not supplied as part of the original template;
third-party applications, plugins, fonts or integrations;
changes, interruptions or failures affecting Squarespace or another third-party service;
content supplied or uploaded by you;
failure to maintain your Squarespace account or subscription; or
use of the template contrary to the instructions or these terms.
You are responsible for reviewing and testing your completed website before publishing it.
Nothing in these terms excludes or restricts liability where doing so would be unlawful, and nothing in these terms affects any statutory rights that cannot legally be excluded.
14. Acceptable Use
Templates must not be used in connection with unlawful, fraudulent, hateful, abusive or otherwise illegal activity.
I reserve the right to refuse further support or services where I reasonably believe a template is being used unlawfully or in serious breach of these terms.
15. Intellectual Property
The original template design and the guides, instructions, tutorials and other original materials supplied with it remain the intellectual property of Clare Butler Co.
Purchasing a template gives you permission to use it in accordance with the licence set out above. It does not transfer ownership of the original template design or associated intellectual property to you.
Your own copy, photography, branding and other material remain yours or the property of their respective owners.
16. Breach of Licence
If you materially breach these licence terms, including by sharing, reselling or repeatedly using a template without purchasing the required additional licences, I may terminate your permission to use the template and/or refuse further template support.
This does not prevent me from taking other reasonable steps to protect my intellectual property where appropriate.
17. Changes to These Terms
I may update these terms from time to time to reflect changes to my products, services, business practices or applicable requirements.
The terms applying to your template purchase will normally be the version in force at the time you placed your order.
18. Governing Law
These terms are governed by the laws of England and Wales.
If you are purchasing as a consumer, nothing in this section deprives you of any mandatory consumer protection available to you under applicable law.
